Terms of use
Updated for Build 0183. This page sets out the practical platform rules in plain language.
1. The service
FixxWorx introduces and markets independent business products and manages public registration, customer accounts, users, subscriptions, licences, payment status, support and secure product access. Artisan_Plus and SiteForge are separate products with their own code, databases, subscriptions and operational data.
2. Accounts and security
Users must provide accurate information, protect passwords and report unauthorised access. Tenant administrators are responsible for the people they activate and the roles they assign.
3. Trial, subscription and payment
Where a free trial is offered, the period and limits shown on the product page or written offer apply. The current Artisan_Plus trial lasts 14 days and requires no card to start. SiteForge activation may first require a demonstration, capacity review and written confirmation. Continued access is subject to the selected plan, payment status and a valid licence. Prices, once-off setup charges and tax treatment are confirmed on the applicable quote or invoice.
4. Licence and capacity control
The selected plan determines the maximum active users reserved by the licence. FixxWorx may hold new automatic trials when the global tenant or seat ceiling is reached, paused or marked for manual review. Existing valid clients are not simply switched off because the new-activation ceiling has been reached.
5. Acceptable use
The platform may not be used to store unlawful content, bypass security, attempt to access another tenant’s data, disrupt the service or share access with unauthorised people.
6. Availability and support
FixxWorx aims for reliable service, but internet, hosting, device and third-party issues can affect availability. Support requests should be lodged through the client portal or configured support channel.
7. Renewal, changes and cancellation
Monthly subscriptions are made available for successive billing periods until cancelled under the written offer or client portal process. An upgrade or downgrade takes effect as confirmed in writing and may require active users or projects to be brought within the new limit. Periods already supplied, setup and custom work are not automatically refundable unless required by law or approved by FixxWorx in writing.
8. Independent products and optional connection
Artisan_Plus can be used without SiteForge and SiteForge can be used without Artisan_Plus. A connection is activated only when authorised by the relevant customers. Only approved project, work-order, status and evidence data are exchanged. The connection does not give one business general access to another business’s private records.
9. Customer data and backups
The customer retains its rights in business data lawfully placed in the service. The customer must have the necessary authority to process personal, project and contractor information. FixxWorx may apply reasonable backup and recovery measures, but the service does not replace the customer’s legal recordkeeping or project-specific archiving duties.
10. Intellectual property
FixxWorx, Artisan_Plus, SiteForge, the software, trade names, layout, documentation and original content remain the intellectual property of their applicable owner and are licensed, not sold. No source code, product design or trade-mark right transfers to the customer. The customer retains ownership of its own brands and content.
11. Decisions and professional responsibility
The products assist with administration, coordination, evidence and reporting. They do not replace the judgement or legal duties of an architect, engineer, health-and-safety practitioner, quantity surveyor, accountant, tax practitioner or other competent professional. The customer remains responsible for contractual, technical, safety and financial decisions.
12. Suspension and termination
Access may be suspended for non-payment, serious security risk, unlawful use or material breach of these terms. Where reasonable and lawful, the customer will have an opportunity to remedy the issue. On termination, product access ends according to the licence and billing period. Data export or retention is subject to the product’s available export functions, legal duties and any written offboarding process.
13. Liability and governing law
Nothing in these terms excludes rights or liability that may not be excluded under South African law. Subject to those rights, the service is an administration and management tool; FixxWorx is not a party to the customer’s construction, service or subcontract agreements and does not guarantee a contractor’s work, project outcome or payment by a third party. These terms are governed by the laws of the Republic of South Africa.
14. Changes to the service or terms
Products and features may be improved, replaced or discontinued. Material changes affecting an active paying customer’s use or obligations will be communicated through a reasonable channel. The date or build number at the top of this page helps identify the applicable version.
This is practical platform wording, not personal legal advice. Have the final production wording reviewed by an appropriate South African legal professional.
